1. Introduction
Elsewearfit (“Company,” “we,” “us,” or “our”) is based in Switzerland and operates the website [insert website URL] (the “Site”), through which we sell two categories of products: apparel (sweaters and logo sweaters) and NFTs. This Privacy Policy explains how we collect, use, disclose, and protect your personal information in connection with these two product categories, for clients worldwide.
As a Swiss-based company serving an international customer base, we aim to comply with the Swiss Federal Act on Data Protection (FADP), the EU/UK General Data Protection Regulation (GDPR) where applicable, and the California Consumer Privacy Act (CCPA/CPRA). Where these frameworks differ, we apply the higher standard of protection.

4. Legal Basis for Processing
As a Swiss company, our primary obligations arise under the Swiss FADP. For EEA/UK clients, we additionally rely on: performance of a contract (fulfilling your apparel or NFT order), consent (marketing, certain cookies), legitimate interests (fraud prevention, Site improvement), and legal obligation (tax, accounting). California residents have specific rights described in Section 7a.
5. How We Share Your Information
Apparel: manufacturing partners and shipping carriers, to fulfill and deliver your order
NFTs: blockchain networks, wallet providers, and NFT minting/marketplace platforms, to process and record your transaction
Both: payment processors, legal/regulatory authorities where required, and any party involved in a business transfer (merger, acquisition, sale of assets)
We do not sell your personal information to third parties for their own marketing purposes.
6. Cookies and Tracking Technologies
We use cookies to operate the Site, remember your preferences, and analyze traffic, for both apparel and NFT purchase flows. You can control cookies via your browser settings; disabling them may affect Site functionality.
7. Your Rights
Depending on your location, you may have the right to access, correct, or delete your personal information; object to or restrict processing; request data portability; withdraw consent; and lodge a complaint with a data protection authority. To exercise these rights, contact us at [insert contact email].
Please note: for NFT-related data, we cannot alter or delete information recorded on a public blockchain.
7a. Additional Rights for California Residents (CCPA/CPRA)
California residents may know what personal information we collect (for both apparel and NFT transactions), request deletion (subject to legal and blockchain limitations), correct inaccurate information, opt out of sale/sharing (we do not sell personal information), and are protected from discrimination for exercising these rights.
8. Data Security
We implement reasonable technical and organizational measures to protect your personal information across both apparel and NFT transactions. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, particularly for blockchain and cryptocurrency-related data.
9. Data Retention
We retain apparel order data for as long as necessary to fulfill orders and meet legal/tax obligations. NFT-related transaction data recorded on the blockchain cannot be deleted due to the nature of distributed ledger technology.
10. International Data Transfers
Your data is primarily processed in Switzerland. Because we serve international clients and use global manufacturing, shipping, payment, and blockchain service providers, your data may be transferred to other countries. We use appropriate safeguards (Swiss FDPIC-recognized mechanisms or Standard Contractual Clauses) for such transfers.

Our Site is not directed to children under 16, and we do not knowingly collect personal information from children, whether for apparel or NFT purchases.
